Agreement to Terms

By accessing or using Tarpers' website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services. These terms apply to all users, including homeowners, insurance companies, contractors, and vendors.

Service Description

Tarpers provides emergency roof tarping services using non-destructive methods, as well as e-commerce sales of related products (TarpBags). Our services are available throughout Florida year-round and extend to other southeastern states during hurricane events.

Emergency tarping is a temporary measure designed to prevent further damage until permanent repairs can be completed. Tarps are not a permanent solution and require timely follow-up with permanent roof repairs.

Service Terms

Emergency Services

  • Services are subject to availability and weather conditions
  • Response times may vary during high-demand periods (hurricanes, major storms)
  • Service areas may be prioritized based on severity and safety considerations
  • Pricing is subject to change based on scope of work and site conditions
  • Payment terms will be outlined in your service agreement

E-Commerce Purchases

  • All product sales are final unless items are defective
  • Prices and availability are subject to change without notice
  • Shipping times are estimates and not guaranteed
  • Risk of loss passes to buyer upon delivery
  • We reserve the right to limit quantities

Customer Responsibilities

  • Provide accurate property information and access
  • Ensure safe working conditions for our crew
  • Secure pets and remove obstacles from work areas
  • Coordinate with insurance companies for claims processing
  • Schedule permanent repairs in a timely manner
  • Inspect installed tarps and report issues promptly

Limitation of Liability

IMPORTANT: Emergency tarping is a temporary protective measure. While we use industry-best practices and professional installation methods, we cannot guarantee that tarps will prevent all water intrusion or damage during subsequent storms or severe weather.

To the maximum extent permitted by law, Tarpers shall not be liable for:

  • Damage from subsequent storms or weather events after installation
  • Delays in service due to weather, safety concerns, or high demand
  • Pre-existing roof damage not caused by our installation
  • Consequential, incidental, or indirect damages
  • Losses exceeding the amount paid for our services

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.

Insurance Claims

We work with insurance companies and provide documentation compatible with Symbility and Xactware platforms. However:

  • You are responsible for your insurance deductible and any non-covered expenses
  • We do not guarantee insurance claim approval or coverage amounts
  • Payment for services is ultimately the customer's responsibility
  • We may require upfront payment or deposits depending on circumstances

Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Tarpers and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Indemnification

You agree to indemnify and hold Tarpers harmless from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these terms, misuse of our services, or violation of any laws or third-party rights.

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through:

  1. Good Faith Negotiation: We will attempt to resolve disputes through direct communication
  2. Mediation: If negotiation fails, disputes may be submitted to mediation
  3. Binding Arbitration: Unresolved disputes shall be settled by binding arbitration in Florida

These terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

Modification of Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
